These Terms and Conditions apply when you use theracecanvasco.com or place an order with The Race Canvas Co.

Please read them before ordering. By placing an order, you agree to these terms.

1. About us

The Race Canvas Co. is operated by:

In these terms, “we”, “us” and “our” refer to The Race Canvas Co. “You” and “your” refer to the customer.

2. Our products

We transform customer-supplied race photographs into digital artwork and arrange for the approved artwork to be printed onto canvas.

Each product is personalised and created specifically for the customer using:

  • The photograph supplied
  • The selected canvas size
  • The selected orientation
  • The generated or refined artwork
  • Any agreed amendments

Product photographs and mockups on our website are examples. Your finished artwork will vary because every customer photograph is different.

3. Placing an order

To place an order, you must:

  1. Choose the canvas size and orientation.
  2. Upload a suitable photograph.
  3. Generate or review the artwork preview where available.
  4. Confirm that you have the right to use the photograph.
  5. Provide accurate contact, billing and delivery information.
  6. Pay the total price shown at checkout.

You must be at least 18 years old and legally capable of entering into a contract.

After ordering, you should receive an order-confirmation email. A binding contract is formed when we accept your order and begin processing it.

We may refuse or cancel an order where:

  • Payment has not been authorised
  • The photograph is unsuitable
  • The upload breaches these terms
  • The order contains an obvious price or description error
  • We cannot reasonably produce the requested artwork
  • We suspect fraud, misuse or unlawful activity

If we cancel an order before completing the work, we will refund the amount paid unless we are legally entitled to deduct reasonable costs already incurred.

4. Photographs you upload

You confirm that:

  • You own the photograph or have permission to use it
  • You have permission from the photographer where required
  • You have appropriate permission concerning identifiable people in the photograph
  • The photograph does not infringe copyright, privacy, publicity or other rights
  • The photograph is not unlawful, threatening, abusive, discriminatory or obscene
  • The photograph does not contain material that would make processing or printing unlawful

You remain responsible for the photograph you provide.

You grant us a limited licence to store, copy, edit, transform and share the photograph with our necessary service providers solely to create, produce, fulfil and support your order.

You do not transfer ownership of your original photograph to us.

5. Unsuitable photographs

The quality of the artwork depends partly on the quality and composition of the photograph supplied.

We may contact you for a replacement photograph where the image is:

  • Blurred or very low resolution
  • Heavily cropped
  • Too dark or overexposed
  • Obstructed
  • Too small for the selected canvas
  • Unsuitable for the requested orientation
  • Subject to apparent copyright or permission concerns

If you do not provide a suitable replacement within a reasonable period, we may cancel the order and refund you, less any fair and reasonable costs already incurred where permitted by law.

6. Automated artwork previews

Where available, our website may use artificial intelligence to produce an instant artwork preview.

The preview:

  • Is an artistic interpretation of your uploaded photograph
  • Is not a guaranteed exact representation of the final printed canvas
  • May alter small details such as race numbers, text, logos, hands, facial details or backgrounds
  • Is supplied at reduced resolution and may include a watermark
  • Is intended to demonstrate the proposed style and composition

We personally review and may refine paid artwork before printing.

Automated previews must not be copied, reproduced, removed from the website or commercially used without our permission.

7. Artwork approval

Where we send a separate digital proof, you are responsible for checking:

  • The overall appearance
  • Composition and cropping
  • Orientation
  • Any requested amendments
  • Names, wording or other details where applicable

Once you approve the proof, we may send the canvas into production.

After approval and production have begun, further changes may not be possible. If changes are still possible, we may charge any additional production or design costs caused by the requested change.

Approval does not remove your statutory rights where the finished product is faulty, damaged or materially different from the approved artwork.

8. Artistic interpretation

Our products involve creative and artistic judgement.

By ordering, you accept that:

  • Brushwork, colour, texture and details are interpreted artistically
  • Some background elements may be simplified
  • Small or unclear details may not be reproduced precisely
  • Colours may appear differently on screens and printed canvas
  • The final crop depends on the dimensions and orientation selected
  • Part of the artwork may wrap around the sides of the canvas where a gallery-wrap format is used

Minor artistic variations that do not make the product faulty or materially different from the approved proof are not defects.

9. Prices

Prices are shown in pounds sterling.

The total payable price will be displayed before you complete checkout and may include:

  • The canvas
  • Artwork creation
  • Selected size or variation
  • Delivery charges
  • Any applicable tax

We may change prices at any time, but price changes will not affect accepted orders.

If an obvious pricing error occurs, we may contact you for instructions or cancel and refund the order.

Online traders must provide clear pricing and key contract information before customers order. (GOV.UK)

10. Payment

Payment is taken through the payment methods offered at checkout, including Stripe where available.

Your order may not be processed until payment has been successfully authorised.

We do not directly store your complete payment-card details.

11. Production and delivery

Production estimates begin once:

  • Payment has cleared
  • We have received a usable photograph
  • Any required artwork proof has been approved

Any production or delivery dates shown are estimates unless we expressly agree that a date is guaranteed.

We are not responsible for delays caused by:

  • You providing incomplete or inaccurate information
  • Delayed artwork approval
  • Replacement photographs being required
  • Printing-supplier delays
  • Courier disruption
  • Severe weather
  • Events outside our reasonable control

Unless another period has been agreed, online orders should generally be delivered within 30 days. (GOV.UK)

You are responsible for providing a complete and accurate delivery address. Additional delivery costs caused by an incorrect address may be charged to you.

12. Risk and ownership

Responsibility for the physical canvas passes to you when it is delivered to you or to a person you nominated.

Ownership passes once we have received full payment and the product has been delivered.

13. Personalised products and cancellation

Our canvases are made using the customer’s photograph and are therefore created to the customer’s specifications or clearly personalised.

The usual distance-selling right to cancel for a change of mind does not normally apply to goods made to a consumer’s specifications or clearly personalised. (Legislation.gov.uk)

You may request cancellation before artwork or production work begins. Where we can stop the order without incurring costs, we will normally provide a full refund.

Once artwork creation or production has begun, we may refuse a change-of-mind cancellation or deduct reasonable costs already incurred, subject to consumer law.

This does not affect your rights where the product is faulty, damaged, not as described or otherwise fails to meet legal standards.

14. Damaged, faulty or incorrect products

Please inspect your canvas promptly after delivery.

Contact rob@theracecanvasco.com as soon as possible if it is:

  • Damaged in transit
  • Faulty
  • Incorrectly produced
  • Materially different from the approved proof
  • Not as described

Please provide:

  • Your order number
  • A description of the problem
  • Clear photographs of the canvas
  • Photographs of the packaging where transit damage is involved

We may ask you to retain the product and packaging while the issue is investigated.

Consumers are entitled to remedies where goods are faulty, not as described or do not perform as they should. Personalisation does not remove those statutory rights. (GOV.UK)

Depending on the circumstances and your legal rights, we may offer:

  • A replacement
  • A repair or reprint
  • A price reduction
  • A full or partial refund

15. Returns

Do not return a canvas without contacting us first.

Where a return is required because the product is faulty, damaged or incorrect, we will provide appropriate return instructions and meet reasonable return costs where legally required.

Change-of-mind returns are not accepted for personalised canvases unless we expressly agree otherwise.

16. Replacements

Where we agree to replace an item, the replacement will normally be produced using the approved artwork and original order specifications.

We may require the damaged or incorrect canvas to be returned, photographed or made unavailable for further use before issuing a replacement.

17. Intellectual property

The website, branding, example artwork, product descriptions, layouts, graphics and software are owned by us or licensed to us.

You may not copy, reproduce or commercially exploit them without permission.

You retain your rights in the original photograph, subject to any rights held by its photographer or other rights holder.

Unless separately agreed, purchasing a canvas does not give you rights to:

  • Resell the artwork commercially
  • Produce additional copies
  • Use the artwork as business branding
  • Sell merchandise featuring the artwork
  • Remove a preview watermark
  • Claim that you created the artwork

The physical canvas is for personal use.

18. Use of finished artwork for promotion

We will not use your identifiable photograph or finished artwork publicly for advertising, social media or portfolio purposes without permission.

Where you give permission, you may withdraw it for future use by contacting us. Withdrawal will not necessarily require us to recall material already lawfully printed or published.

19. Website availability

We try to keep the website available and accurate, but we do not guarantee uninterrupted access.

We may suspend, update or withdraw parts of the website for maintenance, security or operational reasons.

20. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of your statutory consumer rights
  • Any other liability that cannot legally be excluded

Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was formed.

We are not responsible for business losses where you purchase as a consumer for personal use.

Consumer contract terms must be fair, transparent and must not remove customers’ statutory rights. (GOV.UK)

21. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, including:

  • Courier disruption
  • Postal strikes
  • Severe weather
  • Supplier interruption
  • Power or internet failure
  • Cyber incidents
  • Government restrictions
  • Natural disasters

We will take reasonable steps to minimise disruption and contact you where your order is materially affected.

22. Complaints

Include your name, order number and a clear explanation of the issue.

We aim to acknowledge complaints promptly and work towards a fair resolution.

23. Changes to these terms

We may update these Terms and Conditions when our products, processes, suppliers or legal responsibilities change.

The terms applying to your order will normally be those published when the order was placed.

24. Governing law

These terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections that apply where you live.

The courts of England and Wales will have jurisdiction, although consumers living in Scotland or Northern Ireland may also be entitled to bring proceedings in their local courts.
